Who we are

This website and our market stalls are run by John Dickson (ABN 23 442 261 705) trading as Delightfully Fresh Organics, a small business on the NSW Central Coast ("we", "us"). Our farm and head office are at 380 Ironbark Rd, Mangrove Mountain NSW 2250. This policy explains how we handle your personal information. We follow the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).

Contact for privacy questions: please contact us through our contact form.

1. What we collect

We collect only what we need to take, deliver and look after your order:

  • Order details: your name, email, phone number, delivery address, delivery instructions (for example where to leave your box), what you order and when.
  • Payment details: if you pay by card or PayPal, your payment is processed by our card payment provider or PayPal. We don't see or store your full card number. We keep a record that you paid, the amount and the last digits or reference the provider gives us. If you pay cash on delivery, we record that it's been paid.
  • Messages: what you send through our contact form, email, phone, text or social media, and our replies.
  • Wholesale customers: your business name, ABN, contact person and billing details.
  • Marketing preferences: whether you've agreed to hear from us, and when and how you agreed.
  • Website use: cookies and similar technology record things like pages viewed, device and browser type, approximate location (from your IP address) and how you found us. See section 7.

We don't need sensitive information such as health details. If you tell us something sensitive (for example in delivery instructions), we use it only to deliver your order. Please don't include anything you don't want our delivery driver to see.

You can browse the website without giving us your name. We can't take or deliver an order anonymously.

2. How we collect it

Mostly from you: when you order, sign up for emails, fill in our contact form, message us or buy from our market stall. We also receive limited information from our payment providers (confirmation that you've paid) and from our website tools (see section 7).

3. Why we use it

  • to take, pack, deliver and charge for your order
  • to contact you about your order, delivery, substitutions, problems or refunds
  • to answer your questions and handle complaints
  • to send you news and offers, but only if you've agreed (section 5)
  • to run and improve our website, prevent spam and fraud, and keep it secure
  • to keep business, tax and accounting records the law requires.

We won't use your information for anything unrelated to these purposes unless you agree or the law allows it.

4. Who we share it with

We don't sell, rent or trade your personal information. We share it only as needed with:

  • Delivery: our own drivers, or a courier or delivery service we use. They get your name, delivery address, phone and delivery instructions.
  • Payment: our card payment provider and PayPal, to process payments and refunds and prevent fraud.
  • Website and email: our website host, our online shop software, any email or newsletter platform we use, and our analytics and spam-protection tools.
  • Professional advisers: our accountant or bookkeeper, lawyers and insurers, when needed.
  • Others where the law requires or allows it, for example a government agency or court, or to protect someone's safety.

Anyone we share information with may only use it to provide their service to us.

5. Emails, texts and marketing

  • We send marketing emails or texts only if you've said yes, for example by ticking the box when you sign up or check out. The box is never pre-ticked.
  • Every marketing message will say it's from Delightfully Fresh Organics, give our contact details and include an easy, free unsubscribe link (or "reply STOP" for texts). We'll stop within 5 working days.
  • Unsubscribing from marketing doesn't stop messages about orders you've placed, such as order confirmations and delivery updates.
  • We follow the Spam Act 2003 (Cth).

6. Overseas disclosure

Some of our service providers (such as our website host, our payment and email providers, and our analytics and spam-protection tools) may store or process information overseas, including in the United States.

We choose established providers that have their own privacy and security commitments. They are still overseas businesses, and Australian privacy law may not apply to them in the same way.

7. Cookies and analytics

Our website uses cookies (small files stored by your browser):

  • Essential cookies: keep your cart working. The shop won't work without them.
  • Analytics: our analytics tool tells us how people use the site in a combined form, such as which pages are popular. It may use cookies and your IP address to do this.
  • Spam and bot protection: our spam-protection tool checks that forms are filled in by a person.

You can block or delete cookies in your browser settings. If you block essential cookies, the cart and checkout may not work.

8. Automated decisions

We don't use computer programs to make decisions about you that significantly affect your rights or interests. People make our decisions (for example whether you're in our delivery area, or how to fix a problem with your order). Payment providers may run automatic fraud checks when you pay, under their own privacy policies.

9. Keeping your information safe

We take reasonable steps to protect your information from misuse, loss, and unauthorised access, change or disclosure. These include secure (HTTPS) checkout, payment handled by the payment provider, and limiting access to people who need it. If a data breach is likely to cause you serious harm, we'll tell you and tell you what to do.

10. How long we keep it

  • Order, payment and tax records: 5 years, as Australian tax law requires.
  • Marketing list: until you unsubscribe. After that we keep only enough to make sure we don't email you again.
  • Contact form messages and complaints: only as long as we need them after the matter is finished.
  • Analytics data: as set in the analytics tool.

When we no longer need information, we delete it or remove anything that identifies you.

11. Access and correction

You can ask for a copy of the personal information we hold about you, and ask us to correct it, by contacting us through our contact form. We'll reply within 30 days. There's no charge. If we can't give you access or make a change, we'll explain why in writing, as far as the law allows.

12. Questions and complaints

Contact us first through our contact form. Tell us what happened and what you'd like us to do. We'll acknowledge your complaint within a reasonable time and aim to resolve it within 30 days.

If you're not happy with our answer, you can complain to the Office of the Australian Information Commissioner (OAIC): www.oaic.gov.au, phone 1300 363 992.

13. Changes to this policy

We'll update this policy when our practices change and show the date at the top. If we make a significant change to how we use your information, we'll let customers know by email or a notice on the website before it takes effect.

Refunds Policy

Last updated: 18 October 2026

Fresh fruit and veg should arrive fresh. If something isn't right, tell us and we'll fix it.

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in this policy or our Terms of Sale takes away these rights.

1. What we'll fix

  • Damaged or spoiled items: produce or eggs that arrive bruised beyond normal handling, rotten, mouldy, wilted, crushed, broken, or not fit to eat within the time you'd normally expect for that item.
  • Wrong items: something you didn't order that we didn't tell you was a substitute, or an item that isn't what we described.
  • Missing items: something you paid for that wasn't in your order.
  • Late or missed delivery that was our fault (see our Terms of Sale and Delivery).

2. How to tell us

  • Please contact us as soon as you can, ideally within 48 hours of delivery (or of buying at our market stall), through our contact form.
  • Please include your name, order number (if you have one), the item and what's wrong. A photo really helps us check what happened and improve our packing. If you have one, say so in your message and we'll reply so you can send it.
  • These are requests, not conditions. If you can't take a photo, or you notice a problem later (for example, an item that looked fine but was spoiled inside), still contact us. We ask you to report quickly because fresh food doesn't keep. It doesn't remove your rights under the law.
  • You don't need to return spoiled produce. Please don't post it back. We may ask you to keep it until we've sorted things out, or to hand it to the driver at your next delivery.

3. What we'll do

  • For a major problem (for example, an item is inedible or not what you ordered), you choose a full refund for that item or a replacement.
  • For a minor problem, we'll put it right, usually with a replacement in your next delivery, a refund for that item or a credit. If we can't fix it within a reasonable time, you can choose a refund.
  • Missing items: we'll refund the item, or send it on your next delivery if you'd prefer.
  • Credit is only ever an option you can choose. We won't make you take a credit instead of a refund when you're entitled to one.
  • How refunds are paid: to the card or PayPal account you paid with, within a reasonable time of us agreeing the refund. For cash-on-delivery orders, we'll arrange the refund with you.
  • If a problem also caused you other reasonably foreseeable loss, tell us and we'll discuss it with you.

4. Substitutions

Our boxes follow the seasons, so we sometimes swap an item that's unavailable or not up to standard for something similar of equal or greater value. We'll let you know about any substitutions.

If you don't want a substitute, tell us when you report it and we'll refund that item's value, or you can tell us in advance through our contact form not to substitute certain items.

5. Change of mind

We don't have to give refunds if you simply change your mind, because fresh food can't be resold. But:

  • you can change or cancel any order free of charge before orders close at 8pm Wednesday, and we'll refund anything you've paid in full
  • after the cut-off we've usually bought and packed your produce, so we can't normally refund a change of mind. We'll always try to help if you contact us.

This doesn't affect your rights when something is wrong with your order.

6. Market stall purchases

The same rights apply. Please come back to the stall or contact us through our contact form and we'll sort it out.

7. Wholesale and business customers

  • Businesses are often "consumers" under the ACL and have the same guarantees, including when goods cost under $100,000 or are of a kind normally bought for personal or household use, as fruit and veg is.
  • The guarantees don't apply where you buy produce to resell it, or to use it up or transform it in production or manufacture (for example, as ingredients a café cooks into meals it sells). Even then, if produce we supply is spoiled, damaged, wrong or missing and you report it as soon as you can, we'll replace it, refund it or credit your account, as you prefer.
  • Any separate written wholesale agreement or quote also applies, but it won't reduce rights the law gives you.

8. Not covered

We aren't responsible for deterioration caused by how produce is stored after delivery. For example, a box left in the sun or not refrigerated for a long time after it was delivered. If produce was already faulty when it arrived, or wasn't packed suitably for delivery, it's covered.

Natural variation in size, shape, colour and surface marks is normal for fresh, seasonal produce and isn't a fault, unless it makes the item unfit to eat or it isn't what we described.

9. Contact

Contact us through our contact form.

If we can't resolve your concern, you can contact NSW Fair Trading.

Terms of Sale and Delivery

Last updated: 18 October 2026

1. Who you're buying from

You're buying from John Dickson (ABN 23 442 261 705) trading as Delightfully Fresh Organics, a small business on the NSW Central Coast ("we", "us"). Our farm and head office are at 380 Ironbark Rd, Mangrove Mountain NSW 2250. You can contact us through our contact form.

2. These terms

These terms apply to orders on our website and, where relevant, to wholesale orders. Our Refunds Policy and Privacy Policy form part of them. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (ACL) or any other law that can't be excluded. If anything here seems to, the law prevails.

3. Ordering and when the contract is made

  • When you place an order, you're offering to buy the items in your cart. We'll email you an order confirmation. The contract is formed when we send that confirmation.
  • We may decline an order, for example if your address is outside our delivery area, an item has sold out or there's an obvious error. If we do, we'll tell you promptly and refund anything you've paid in full.
  • Please check your delivery address and phone number. We'll contact you if we can't find you.

4. Prices, GST and payment

  • Prices are in Australian dollars and include GST where GST applies. Most fresh fruit, vegetables and eggs are GST-free. Your tax invoice shows any GST.
  • Delivery fee: a flat $10 per delivery. It's shown before you pay.
  • If the price at checkout is different from the price displayed on our site, we'll charge you the lower price.
  • Payment: card (processed by our card payment provider), PayPal, or cash on delivery. We don't add a surcharge for paying by card.
  • Card and PayPal payments are taken at checkout. Cash-on-delivery orders are paid to the driver at delivery.

5. Seasonal produce and substitutions

  • We sell fresh, seasonal produce. Box contents listed on our site are the typical contents. What goes in each box follows the seasons and what's at its best that week, so contents, varieties and the exact mix can change from week to week.
  • Fresh produce naturally varies in size, shape, colour and appearance, and weights are approximate for items sold by the piece or bunch.
  • If an item is unavailable or not up to our standard, we may replace it with a similar item of equal or greater value. We'll let you know about any substitutions. If you don't want a substitute, see our Refunds Policy.
  • If we can't fill part of your order at all, we'll refund the missing items.

6. Delivery

  • Where: NSW Central Coast suburbs from Umina Beach in the south to Gwandalan in the north. You can check your suburb on our website.
  • When: orders close at 8pm Wednesday for delivery on Thursday afternoon. We can't give an exact delivery time. Orders placed after the cut-off are delivered the following week.
  • Delays: if weather, road conditions or another problem means we'll be late, we'll let you know as soon as we can. If we miss your delivery day through our fault, you can choose a refund or a new delivery time.
  • If no one's home: we'll leave your order in the safe place you tell us at checkout, out of direct sun where possible. Please choose a shaded spot. If you haven't given a safe place and no one's home, we'll contact you to arrange what happens next.
  • Risk and ownership: your order becomes your responsibility once it's delivered to you or to your chosen safe place. Ownership passes to you when we deliver it and you've paid. This doesn't affect your rights if the produce was faulty when it arrived.

7. Food safety and storage

  • Please bring your order inside and refrigerate perishable items (leafy greens, herbs, berries, mushrooms, cut melon, eggs) as soon as possible after delivery, especially in warm weather.
  • Wash fruit and vegetables before eating. Fresh produce can carry soil or the odd garden visitor.
  • Keep eggs in the fridge in their carton. Don't use cracked or dirty eggs.
  • Our produce is packed alongside other products we sell, including eggs. If you have a serious allergy, contact us before ordering.
  • Our storage tips on product pages are general guidance.

8. Wholesale orders

Wholesale orders (for example cafés and co-ops) are by arrangement. Prices, delivery days, minimum quantities and payment terms are set out in your quote or account terms. These terms apply to the extent your quote doesn't say otherwise.

9. Problems with your order

See our Refunds Policy. In short: tell us as soon as you can, ideally with a photo, and we'll replace, refund or credit (your choice where the law gives you one).

10. Our responsibility (liability)

  • We're responsible for meeting the consumer guarantees and for loss you suffer that was reasonably foreseeable as a result of our failure to meet these terms or the law.
  • We're not responsible for loss caused by your own actions (for example, incorrect delivery details or storing produce badly after delivery), or by events outside our reasonable control such as severe weather, road closures or supplier crop failure. If one of these stops us delivering, we'll tell you and refund any affected items, or deliver as soon as we reasonably can if you'd prefer.
  • Business customers who buy for resale or to use in their own products (who aren't "consumers" under the ACL): to the extent the law allows, our liability for an order is limited to replacing the goods or refunding the price paid, and we aren't liable for loss of profit or indirect loss. This doesn't apply to loss caused by our negligence or wilful misconduct.

11. Market stall sales

Purchases at our market stalls are covered by the same consumer rights. Clauses 3 to 6 don't apply to stall sales.

12. Your information

We handle your personal information as set out in our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time, for example if our delivery days change. The terms that apply are the ones on our site when you place your order.

14. Law that applies

These terms are governed by the laws of New South Wales. Disputes can be dealt with by the NSW courts and tribunals (including the NSW Civil and Administrative Tribunal), or another court with jurisdiction. This doesn't take away your right to contact NSW Fair Trading or the ACCC.
